What was the driver cited for? Not being the owner does not change anything.
Usually when someone is simply rear ended the driver behind is liable (this is true probably 99.999% of the time). The driver not being the owner would not change liability.
I ask why the driver was cited as perhaps this was because they did something wrong... which lead to some liability against the driver.

If it's the liability of the driver then he should be the one who'd pay for the damages. But I guess you're missing out on some information.

Maybe so in a court of law, but in auto insurance, the coverage on the vehicle normally supersedes the driver's coverage if the driver is not the vehicle owner.
