I was driving my truck and trailer,a woman pulled into my path,we collided totaling both.She was ticketed and found at fault.Her insurance was only good for$25000 , my damage estimates were over $100000,so I sued her. She filed bankruptcy, and got her debt dismissed.Allstate has never paid,and I want interest on the $25000 if I ever get it!

This does not make sense... they should have provided her a defense and once a judgement was obtained, they should have issued payment to your for their $25k. Why did this not happen? have you asked Allstate why they have not paid the $25k? You won't get any interest from Allstate on the $25k, you can only collect the $25k.

Your truck and trailer cost over $100k and you did not have collision coverage on them?

m/t if I've learned anything here, it's that you need to have enough coverage to protect yourself. No matter what the responsible party has (or doesn't have) you can move on, and let your carrier deal with them.

I think you mean certified. At $5 a letter, it should cost you that $25k in no time!

A certified letter every 3 days? You can't be serious.

This has bee since 2001 and your just now wondering where the money is? Thats like 8 years ago. Will they still even be liable to pay this since it has been so long?

Allstate has great lawyers, this has been in the court system for 7 years and only recently was her bankrupcy discharged.

:? What's up with that? If you didn't have collision coverage, your underinsured motorist coverage should pick up whatever wasn't paid for by the at-fault person's insurance up to your policy limits. If you didn't have collision coverage, your agent absolutely should have placed UMPD/UIMPD which would have helped pay for this loss. What kind of truck and what kind of trailer? What about the "minor injuries" and whether they were treated by medical personnel?

We need better info...

I was considering this was almost the end of 2008 so it seems pretty close to the 7-8 year mark.
Also master trotter they OP statedits been i the court system for 7 years.
