I was in an accident when it was icing and snowing on the road and damaged my vehicle. I received a check that was written out to me and my lienholder. I sent the check to the lienholder for endorsement and I did not sign the check before sending. They have kept the check so long, we had to pay the shop out of pocket. Since they have had the check for almost a month, my car payment was just due and now they are saying they will not send the check unless I make a payment or they will cash the check and apply part of it towards my payment and send me the remaining amount. Can they cash the check without me endorsing it???? And is this legal for them to hold my insurance check until i make a payment??? :x

Insurance claims and loan payments are unrelated unless the vehicle's damage was a total loss, which is not your situation.

It is ABSOLUTELY UNLAWFUL for the lienholder to impair your right to the insurance claim check by demanding that you make a loan payment. Similarly, you cannot impair their right to collect payments on the vehicle loan -- you are contractually obligated to pay 100% of the loan principal, and interest until the principal is repaid.

The two matters are ENTIRELY UNRELATED ACTIONS. Your lender's demand conditioning sending you the insurance check on you sending a loan payment is not likely to be a part of your loan contract.

If your lienholder cashes the insurance claim check and fails to send you 100% of the money, and instead uses any part the money to pay themselves, that is known as CONVERSION, and they can be sued for doing that (just like it is unlawful for the bank to take money from your savings account without your consent to pay a check written against a different account). If the lienholder signs your name on the back of the check, they have committed FORGERY, for which they can be prosecuted (same as you could be for signing their name).

But don't fail to make your loan payment. For that, they could repossess the vehicle. And you would have little recourse.

It is unconscionable that the lienholder has acted in this manner. You should consider seeking legal counsel to inform them of the error of their ways. In a best case scenario, you might even obtain title to the vehicle with no additional payments as punitive damages. Even if they send you the insurance check after you make your payment, you can still sue them for breach of contract -- but your attorney will need a copy of your loan contract to find the provisions he/she needs to cite as the cause(s) of action.

What if I total out my car with no Insurance on it, but I did have the gap insurance from the dealership wil that with the payoff.

NO. Guaranteed Auto Protection (GAP) insurance only pays some or all of the portion of your loss not paid by your own insurance (or the insurance of someone else who caused your damages). It will never pay the ENTIRE LOSS.

Besides, you do not normally get GAP insurance as a "stand alone" policy, you get it as an added provision in your personal auto policy. If you cancel or lapse your policy, you probably have no GAP protection.

is there some1 out there who can help an absent minded ol fool who was jus trying to make their nephew/nieces lives more "easy" by giving them a vehicle...later is responsible for all the legal woes like repo, accident etc etc. Seriously is there such an ins that can assist....????

I was involved in an accident while driving in inclement weather, I started hydroplaning and lost control of my car. I ended up slamming into a guard rail and damaged the back end of my car. I filed a claim with GMAC, when the adjuster called me back she informed me that the vin number was wrong on my policy(this was my agents fault) and that my car was not covered. My agent admitts to the mistake, but wn't take responsibilty for fixing my car. It has now been 3 weeks. I have complained to the insurance comission and wrote several letters and did not receive a response. I can't find a lawyer to take my case because there was no other car or person involved. What can I do now??

Hello, my wife and I have our two cars covered through progressive insurance in Massachusetts. My wife had told me a few times that her car smelled of mold. Then a few months back I was driving and observed some water pour out of the dome lighting. I suspect that this is coming from a problem with the sunroof. Well now I noticed a VERY strong smell of mold and have discovered, what looks like mold coming out of one of the speakers on the dashboard. I have a 11 month old baby and I do not want her riding in this car one day longer(my car is a 2 door that is in worse shape then my wife's). My question is weather or not you think this is covered under my comprehensive insurance? Please give your advice on how I can go about getting this car either replaced or fixed and mold free.

Under my policies "General Provisions and Exclusions"
this is listed:
9. WE DO NOT PAY FOR ORDINARY WEAR OR TEAR
. .We wll not pay for damage to your auto which is due solely to ordnary wear and
tear, freezng, mechancal or electrcal falure, or for ordnary road damage to tires.
We willl, however, pay for ths damage. if it is the result of some other loss which is
covered by ths polcy.
