Hi, I was on a private road going down hill at night. It was an expensive car that I have been putting lots of money into. Its only about a year in a half old. Anyway as I was driving down hill on a turn my right tire hit a curb and flipped over on its side. I was dazed and someone driving by took me to the hospital. By the time I got back, my vehicle was gone and I couldnt find it for days. I informed my insurance and they opened a claim. A couple of days later after searching I found the car it was towed to a tow yard. The insurance has since picked it up. Iam just wondering if they will cover it if I wasnt at the scene or did not file a police report? Also if they do cover it Iam upside down with gap insurance too, but if it is payed off then what? I lose all the money I have payed into it so far? 15,000 or so. And I have no car now. what do I do?

There shouldn't be any reason they won't cover this claim based on what you have posted...

If the vehicle is a total loss they will owe the ACV (actual cash value) of your vehicle. If you owe more than the vehicle is worth your GAP policy will pick up the difference (less your deductible in some cases). Now unfortunately you're right you may be left without anything (meaning cash) however, you drove it for a year and a half so there is some worth in that right? Cars depreciate quicker than just about anything. Are you certain the vehicle is totaled? If you'd car to post the yr/make/model/mileage and all options, and if there was any PRIOR unrepaired damage, I'll run a value for you...

thanks for your reply and I sure do hope they will cover it. I just got a paper in the mail (maybe old) but it was from the insurance for me to fill out a stolen vehicle declaration. but like I said it was missing, so I hope its just a mistake. It was a 2007 nissan maxima. leather seats all airbags. premium stereo etc. It had a moon roof. I do have pictures of it after but I doubt I can put them up here. pretty sure its totalled though. What sucks is I was paying so much on it a month I got burned. And now what its all gone because the cars trashed? So even though I didnt make an accident report and wasnt there when they took the car it should be covered? Iam in California by the way. Thankyou very much. :D

Well, sure, you were taken in an ambulance right? How long of a time span between the time of the accident, and the time you reported it to your insurance company? When was the last time you talked to your adjuster? You need to call them and see how the claim is coming, and make sure they aren't still considering this a theft....or comp loss, should be a collision loss...RE: what you are paying a month...well that's really no bodys concern or responsibility but yours right? If it's totaled then they will pay you the ACV, nothing more nothing less, if it's a high end car, then perhaps it isn't totaled and they will be able to repair it....Ask the adjuster if anyone has inspected it yet, and if they have determined if it is a total loss or if it is repairable....let us know how it's going and if we can be of any assistance, don't hesitate to ask.

well again thanks, I told you no I wasnt in an ambulance. A passer by took me to the hospital, but I wasnt that bad and dont have health insurance. So I ended up not staying long enough to get treated. I waited about a day and a half two days before I notified my insurance. I am going to see how its coming along. but just wondering if from any of what Ive stated they could try and not cover it. 2 days before I reported it. left the scene, no police report or accident report thats what Iam wondering.

I said I was teaken to the hospital by a passer by. I dont have health insurance and wasnt I felt hurt that bad so I didnt stay and be seen. I reported it 2 days later to my insurance when I couldnt find the car. and later I did find it on my own. Iam wondering because I left and because I didnt make a report and waited 2 days to tell them can they try and deny the claim? Thats all Iam wondering and yes I am in contact with the adjuster.

I doubt it however they may ask you why you didn't report it sooner, and you just tell them the truth you were knocked silly and when your head was back on straight you called them. I am really surprised that the passerby or the police didn't call you after having the vehicle towed, but apparently they weren't worried about it...that's odd, but not enough reason to deny a claim...you shouldn't have any worries in that regard, other than having to explain what happened and your late report...if you have medpay or pip, then they will also take care of your medical bills at the hospital.
