car accident

I live in south western Pennsylvania and was in a car accident just recently where the other driver was at fault.My car is a 98 subaru forester s class with 92,000 miles on it and is in excellent condition(or used to be)valued at $10,200.I was hit in the driver side rear quarter panel and door. Which also damaged inside the wheel well and my car now shimmy's where the car was hit.Now making me wonder if it has frame damage.MY question is his insurance company wants to use used OEM parts and i think i should get brand new OEM parts for my car because they were before my car was hit.Now does my car have more of a DV (diminished value) using used OEM parts or is it no matter if they are brand new OEM parts or used OEM parts DV?And can i fight them to get that DV from them or do i just get the shaft on this?Also,they estimated the value of the crash at $3,000 which i find ridiculous,cause the damage on the car is far more than that probably double that. Thank you to anyone who can answer my question.

No, Corbinjt, Used (10-11yr old to be exact) Oem parts are what are on your car now. Not NEW oem parts....If they are putting used parts on your vehicle it would be the exact same thing if your vehicle were totaled and went to a salvage yard, and the opposite side (for instance) doors etc were undamaged, and they sold those doors to put on another 98 would you think anything was wrong with that? Course not....The shop will not put the parts on your car, (I'm assuming a 1/4 and door) if they are not in good shape, that's their job....

Using these parts has no impact on a DV claim at all....

And can i fight them to get that DV from them or do i just get the shaft on this?

What shaft? they are putting the EXACT same parts on your car that were on it prior to the impact....

Based on what? Why do you think this ridiculous? What makes you think the damage is 6k? If you don't want them to fix your car tell them to just give you the cost of repair, and go on down the road

If your vehicle was hit in the tire or wheel the aligmnment was likely knocked out you could also have a bent wheel or some suspension damage, if you are still driving it stop it, and ask them for a rental and get your car to the shop to get it repaired...

As mentioned, what you had and what they are paying for are both OEM parts. What your asking for is a brand new part to replace your 10 year old parts. You think this is the same thing?

You can ask for DV, even demand it. I'll leave it up to the carrier to let you know if they are going to pay DV.

I'm betting that the shop will inform the carrier that additional repairs were needed and/or more money is owed for the repairs. If that is the case, the insurance company will simply issue another payment. It happens all of the time.
