Being sued for an auto accident

I am being sued for an auto accident that happened in March of 2008. I hit someone in a parking lot and the police were not called. I thought i was covered under my grandmothers insurance, so i gave the man i hit my insurance info and we left. I called my grandmother the next day to let her know what had happened and she said she "wasn't" sure if she had dropped my car insurance or not, so i called her insurance company and she had dropped it months before this accident and didn't tell me about it. She now has been diagnosed with Dementia. I am also a full time nursing student, and only work part time and do not bring home more than 900 dollars a month. What will happen to me if i lose the case? I was served with papers 2 weeks after the 2 year anniversary of the accident, although they were stamped by the court 1 week before the 2 year mark, i live in arizona and the statues of limitations is 2 years does that count as the stamp or the day i received it? Will the fact that my grandma has dimentia help me in court? Plus i never spoke to his insurance company about the accident so i don't know how they automatically found me at fault without even speaking to me? I am just worried that they are going to garnish my wages, and i wont be able to survive through nursing school. HELP!! :cry:

hello, i am very sorry about what happened. I hope that this dilemme that you're going through would not affect your studies. I'm a nursing student as well, so I totally feel your agony.


with regards to the fact that your grandma has dementia, i don't think it will still help you in court as what you said, your grandma has already dropped her automobile insurance MONTHS before the accident happened. so they already have a clear view that you'd been driving without an insurance. I suggest that you also give his insurance company a call or better yet, wait for them to reach you to hear your side of the story. They actually need to so that their report would not be called biased.

No Police report? What information did you provide to this person?
Any witnesses? Can anyone prove you were there at the time of the accident?
How much damage was done?
Working out a settlement and payment plan with the Insurance company that is suing you may be your only option. If you get a lawyer you will have to pay them and pay the insurance company. My advice is to work out a deal with the company and pay over time.
