First... it takes more then a simple missed payment for a policy to lapse. I'm guessing it takes around 45 days at least and several letters notifying you of the late payment.

Contact the other person's carrier to see if they will address your loss.

Since your insurer wouldn't address the loss, the option remains is to file the claim with the other driver's insurer. Turn the claim in and wait to hear from them. If the other driver has indeed caused the accident his insurer would cover the losses. Just keep praying that the other guy too doesn't turn-out an uninsured motorist like you.

i won't find any solution for the loss recovery as your policy is lapsed, don't take it personally but it's the fact.

Hope other driver's insurer will settle the claim.

If the person that hit you was at fault then his inusrance company will cover the repairs on your vehicle. I am not certain if you would get any money towards pain and suffering. I have heard of places having a no pay law..this menaing if you yourself are an uninsured driver then you can not collect any money for pain and suffering. I myself feel it is an excellent law and all places should have one like this. It would keep people from driving uninsured knowingly or not.
