We had a accident with our 2009 Honda Fit. Repairs were made which totaled approx. $9K, however when the body shop was replacing the air bags they trashed our dashboard, seats, headliner. Our insurance company agrees with us and we will be bringing our car to another shop. Question is, with the 2nd round of repairs, which will be close to $5K, this will be close to the amount my car is worth now. Our insurer agrees when the car reaches this amount it is "totaled". However, the first body shop will be picking up the second cost. Do we have a case here to get our insurer to consider our car "totaled"? Any help would be appreciated.

I am of the opinion that if the damage caused by the shop was not a result of the accident and a separate occurence, this should be a new comprehensive claim with a new deductible which should be subrogated against the shop that caused the damage. Your deductible should be collected as well.

Does your insurance co. know the details of the mishap that took place at the body shop?
