Hi just wondering if anyone can help. I was in a solo accident. my vehicle was totaled. I was taken to the hospital by a good samaritan. when I returned my vehicle was gone. I didnt know it was totaled but it was overturned. I could not find it. No law enforcement contacted me. I contacted my insurance 2 days later. I went to the police and all they would do was file it missing because I was in an accident and it was overturned. A couple of days later through searching I found out that it was towed to a tow yard apparently by the highway patrol. It was not impounded just towed. This happened apparently on a private road. I informed the insurance it was towed and they did pick it up.Now, they want me to fill out an affidavet regaurding "theft" I asked my adjuster about this and he said it was ok, because I didnt know where it was when I reported it to them. And that it would be straightened out. Iam wondering if I should indeed do this, because the car is a total loss. They will lose money, and it was NOT stolen. Can anyone please help? I dont want to do something illegal and also jeopordize my claim. Thankyou.

well, yes the way you make it sound, sounds very suspicious. lol, but simply I gave this person a ride up the hill. The car flipped on its side but we werent injured. If the police where looking for me why didnt they find me? Thats why I couldnt find my vehicle. And was contacting them. I had been going through so much at that time it just made me act on stupidity. I have been a good driver all this time if they dont want to insure me I understand, but you dont understand it was kind of in the mountains, so it would have taken time for anyone to come. Thas why she took me and we left the car there.

You've spoken to this passenger since the accident to confirm this? Regardless, once he speaks to someone who tells him he can get money from you, his view might changed. If the insurance pays the claim or pays the car, where is the check going to go? and how would I go about my GAP insurance there after?

The check would be sent to your leinholder for up to the amount to pay off the vehicle. You need to contact your GAP carrier once you know if the insurance check will be insufficient to pay off the vehicle and let them know of the situation.

To tcope, about all this. I have prettymuch told you everything there was to tell about the accident with my own car. And Ive been contacting the adjuster. Yesterday he told me it was in the final stages etc and they would be getting to me about numbers. Well, they have my car still. And now today are telling me theyre gonna have a P.I. come out and take a personal statement from me. That his supervisor forwarded it to them, I guess to investigate it. So, now hes saying they will then let me know what theyre gonna do. Does that mean they are gonna decide wether or not to cover it or what? And then what? Do they have to give me my car back if they dont? It will probablly be re poed by then because the Lien holder keeps calling about theyre payment. So just wondered maybe what you thought. Thanks. (by the way lol, as soon as I get my bank straightened out and can use my card I will make a donation to you for all your help.) Thanks again.
