I have a ins check that me & a ex girlfriend have been issued for the damages to my car & she signed her name & my name & put it in the bank... i found out about the check from Allstate & tried 2 get my money but she is trying to keep it so I contacted the bank & let them know i didnt sign it & they froze the account of hers till me or her can prove whose money is what since both names are on the check... how can i prove its my money...it is a check for the damage 2 my car which is in my name only.

Who was the named insured on the policy? If it was you, why would Allstate put her name on the check?

Let Allstate know what the deal is and supply them with documentation that only you own the vehicle. I'm guessing your listed on the policy?

The bank does not care who's money it is... only that someone committed fraud by signing someone else's name. If she forged your name the bank will have you fill out a fraud affidavit so that they can look into the matter. If they confirm that you did not sign the check, they will back out the funds and void the check. You can then obtain a replacement from Allstate.

Pretty easy, if it's your car, and it's a draft for damages to your car...just call Allstate, ask that they stop payment on that draft and reissue one in your name only...let them know what this 'peach' of a girl did :roll:

Well come to find out she didnt sign my name to the check ... she had her friend sign it & the idiots at the bank allowed her to deposit it in their account. Regions supposivly fired the teller but still have the account froze. The policy was in her name & Allstate had messed up by even allowing coverage with out having my name on the policy.. about 10 people has made mistakes that lead up to my BS problem... ya her name should have never been on the check to start with... IDK how to convince the bank to give me my $27.000 still.

I wouldn't even be messing with the bank. Contact the carrier have them stop payment on that draft (I stop payment about once a month on a draft for one reason or another) and reissue to the owner (you)...if the adjuster gives you any problems with it ask to speak to the adjusters supervisor and keep climbing if necessary. It's pretty easy to prove you are the vehicle owner...forget about the bank...have the cops been notified about this forgery?
