how do you get the ins.co.to pay for help needed after an au

we had an auto accident -my back was broken-supp
osed to be able to have house help and personal
help- yet they won't pay even the pittance they
claim to allow--where do I go for recourse? I am
80 years old and my husband is 83-we do need
help

where do you go to get an ins. co. to pay what they say they should for
an injury- they're supposed to pay for House chore help and personal
help but they are not paying for the prescribed help needed--what State
office helps in a situation like this?

Which state are you in?

Who was the party at-fault? Have you spoken to your insurer regarding the claim?

If you were injured in an accident where the other driver is at-fault, you may be entitled to receive for the medical expenses depending upon your state law. However, we can only make conjectures at this moment. Please try to give us a full account of the incident. It'd help us to understand the situation better.

Hi tobo,

I empathize with you. It's so sad that you and your husband have to suffer through this. However, has the insurance company denied the claim? Presuming that they have, haven't they put the reason for denial in writing?

If it's a bodily injury liability claim on a third party insurance, you are entitled to receive the following compensations

  • Prescription drugs
  • Doctor's visits and medical treatments
  • Nursing home expenses
  • Wage/income loss (if any)
  • Pains and sufferings


However, if you have Personal Injury Protection coverage with your auto policy or have a health plan, you can turn the claim to your insurer as well.

The insurer may then recover the amount that it has paid towards your claim (including the deductibles or co-pay paid by you) form the other driver's insurer through subrogation.
