What should i do if i can't find the other person to sign

My insurance wrote me a check to me and my uncle..Now my uncle is no where to be found, no contact or anything. He's not even on the insurance policy n e more. Well he was never in the whole car accident problem. The insurance wont do anything about it and i cant cash it anywhere..any clue wat i should do.

Didn't you report the accident to the police?

He's not even on the insurance policy n e more.


Did you have a word with your carrier regarding this? Didn't you notify it to your carrier that this person is missing? What does their records say?

yeah, yeah he is...apparently as either, a named insured, co-owner, owner of the vehicle or lein holder...

Well he was never in the whole car accident problem.

That makes no difference..

The insurance wont do anything about it and i cant cash it anywhere..any clue wat i should do.

I'll need you to answer a couple of questions first..

Is your vehicle totaled or repairable?
Is this your company or another (at fault) company you're dealing with?
What state are you in?
How and why , what capcity is your Uncle on your policy about? (insured, co-signer/owner of the vehcle) How and why is he on the policy?

Now my uncle is no where to be found, no contact or anything.

Come on someone in the family knows where he is...sisters, brothers, mom, dad, HIS kids...?

Answer the questions, so we can get a clearer picture why they (ins company) have to protect your Uncle. Then we will then be better equiped to answer your questions.

Kim, you may need to provide more information on your situation. As Lori has mentioned if your uncle is on the title or was the lienholder the insurer is liable to protect his interest too when compensating you. And, therefore, they have added his name on the check.

Please response to the questions asked by Lori and we would then try to offer more help to you.

Your uncle would have to sign this check also. When I got a check recently from an insurance comapny both my husband and my name was on the check. We both did have to sign. Even on the bodily injury check they included my husbands name even though he was not hurt. He had to sign off on that one too. I didn;t quite understand why they included his name on that since it was not to cover the vehicle damages. I do know on both he had to sign off.
Surely though as Lori said someone has to know where this uncle is. I would contact any person whom he has been associated with. Someone would have to know something.

I think the OP needs to provide us with lot more information since we don't even know whether she is referring to property damage claim or injury claim.

Hi Firey, why exactly your husbands name was included in the claim check? Haven't you asked the insurance company about it?

Guys, in most states a spouse will have to sign off on a BI claim as well as the injured party because he too has/had a claim for loss of consortium, ( :roll: ), companionship etc...

Also in the case of a Hostile Divorce they wouldn't want to be responsible for the Wrong Spouse getting the Check.

true...you know I've had more than a few claims..where in the injured party was estranged from their spouse, and me insisting that I cannot give them the draft without the spouse signing the release, then they have to get them to sign the draft.. :roll: what a mess! But nothing we can do...have to get their signatures...

I thought it was because the truck was just in my hubby's name. (He bought it as a surprise for me). I know he had to sign a release AND the check. It was made out to both. This only happened with the check from the other persons insurance.
When the one came from my insurance company my hubby's name was not on the release or the check which was why I thought the first check was made out to both of us because of the him being on the title.
WOW I can see how difficult it could be if it was not a good marriage. Glad I didn't have to go through that. I just signed my check and sent him to the bank and then aorund to pay off bills. Pitty anyone who doesn't have a good marriage and in an accident.
