I have accrued 240 hrs of sick leave, this will be exhausted, due to a DRUNK driver... I have to claim leave or go without a check.. Do I have the right to have it replaced, in case of an illness?

I would think that you could "get back" any loss of monies from employment. Now, could you (an attorney) argue that the "paid" days you had to take off have value? Absolutely.

Yeo all those sick days do have value. These are non-medical special damage expenses and can definately be claimed and assigned a value to. Keep in mind that you would have been able to use that sick leave for other times when you needed it. Using sick leave is to be considered the same as losing pay itself.

yes, be sure the adjuster knows about this I have always reimbursed bi claimants for any sick time they had to use from their employer same as any other 'special'..

Pretty fair. I mean who wants to use their sick or vacation days because of someone else.
