Insurers liability

Hello community. Just had a question regaurding insurers liability in California. If there was a full coverage auto policy, and in which a vehicle accident accurred with only the insureds vehicle and the insured was "intoxicated" but was not arrested for dui would the claim be covered?

I don't know of any policy that excludes DUI, charged or not. It's a sure bet the policy will be non-renewed if the carrier finds out though.

I agree with T fully, unless the policy says something to the contrary. I've only seen one that did and it was only two companys that offered the agreement/endorcement added to the policy that dwi's/drinking while driving would not be covered, (damage to the ins vehicle only of course) also made the rates much much lower, don't even know if they write that anymore that's been 15 years or more...ago...if no arrest how would they know the driver was drunk?

Well, you may be lucky this time. The insurance company has no provision to exclude claims caused by the driver while driving under influence, which IMO they should have. Driving under influence is a felony and every year about a third of the road accidents are caused by people driving under influence.

However, this should be a learning experience…its lucky for you that no other vehicle was involved in the accident, but it could have been worse.

I think that even if the insurer entertains the claim they will seriously give a second thought about renewing your policy next time, or may renewing it at high price.

In your case I think you can claim your insurance and your insurance company may even accept it.But afterwords when it's time for you to renew your insurance your premium will definitely increase ,like Jeremy said.
