I was rear ended on 12/17/07. Transported to ER.Neck Xrays showed no damage.went to physical ther.for 2 months.Numbness in hands and shocking sensation through body got worse. I demanded a MRI.It showed that my spinal cord was almost severed.(lower neck)I was also rear ended on 1/13/08 (while going to phys. ther.) spraining my right wrist. Surgery was done the day after the MRI was performed.Igot a lawyer at that point. Could not work for 7 months. (self employed HVAC service) PIP only paid me for 5 months (1250 mo.) I guess you have to ask for that. Well, because of the 7 months of not being able to work my buisness failed. My lawyer is suing the other ins. co. I have 100,000/300,00 coverage limits and UMBI on 2 seperate policys (same company)I also have PIP on those policys. My wife also has the same company and coverage on her car. It seems that after buying that much insurance for so long with the same company that my situation should not be of complete failure. I have lost everything I own. I am looking for work but as of right now my hands still have hypersensitivity andhurt like hell. I have 1 more month before foreclosure begins on my home. Can anyone help? Thanks

Well Z I'm awful sorry to hear about this....but your attorney is the one that should be moving toward settlement with the at fault carrier(s) what does your attorney say re: settlement...or are you saying that both accidents were caused by uninsured drivers? If so same is true, your atty is in (hopefully) negotiations with your carrier to settle your claim(s)...in what stage are the negotiations?

I will say one thing here. When it comes to atty's their last worry is how you are struggling finacially. Most want to push the claim up until the statutes of limits are set to expire. I kind of know what you are going through. My atty always said "just contining paying everything the best you can". Soemtimes this is almost impossible. I wish you luck and really hope things are better for you and your family in the near future.

I have never posted in a forum before and cant type so sorry for the slowness. I seems my injury and all I have lost is worth more than 25,000. Causation What! I diddnt cause the accident.

where is the 25k coming from ? is that the limit of the at fault party? If so then unfortunately that's it unless they have additional assets you can get...also your UM will not kick in at all if the at fault party is insured...If you have UIM (UNDER insured motorists) coverage that is different..do you and also what state are you in...re: causation, do you mean causing the accident or the injury?

I am in Oregon, I dont know where thr 25K is coming from. The causation question is the injury (lower neck). I have uninsured mtst Bodily Injury coverage @ 100.000. The at fault party has claimed bankruptcy. Can my policy help me?

UNinsured motorist won't help you at all UNDER insured motorist may...do you have UNDER insured motorist (UIMBI)? I'll check the laws in oregon...do you have medpay or pip?

Ok Oregon IS pip state...per the or.dept of ins...

Personal Injury Protection (PIP) (Oregon law requires a minimum of $15,000 per person);

this means you have atleast 15k in pip on YOUR vehicle...have you filed this claim with YOUR carrier?
