on freeway my 99 vette in fast lane at 65 mph , on right a lancer at 70mph swerves into my lane pushes me up and on top of k rail ,, I had no injuries but vette was totaled. Signed off the medical . my insurance handled the claim (farmers) against (bristol West) All I wanted was the rental vehicle I got for 20 days to be reimbursed and Out of pocket expenses taken care of . Bristol West says the policy has reached the limit . Now there has been a secondary (allstate) insurance which is the drivers insurance. (women was driving boyfriends car) he had Bristol West . Now I have been waiting since november . Farmers paid my loan and Gap paid gap. Both Gap and Farmers took out my 1000 deductible and it has left me owing the lienholder 2000 still. I have till the 20th to come up with it before my credit turns to junk. I have recieved nothing, iam without a vehicle still and my bank and credit has been on a domino effect downward because of it. It makes me madder and madder to go thru all this. I cannot get a vehicle due to the money still owed on lien. I just want my life back to normal and due something to get me back in a vehicle (such as a down payment etc) My insurance agent says he can help me with Farmers but as far as Allstate,, I am on my own as he has no pull with them. I talked to the adjuster of Farmers this am and she gave me the number to call Allstate to see if I could get it moving faster. Im getting nowhere and wonder why my insurance policy of 50/100/50 cover this. Why am I still waiting. Not sure what to do. Let's start with Farmers and the GAP policy. If I understand it correctly, you have a $1000 deductible? I did not now a lienholder would allow such a large deducible. But this is the first complication... you have a $1000 and it appears you don't have $1000 to pay. Farmers should pay up to the value of the vehicle. It seems like you are upside down, that is... you owe more then your vehicle is worth. Part of the second problem. But you have GAP insurance. The GAP policy appears to have another $1000 deductible. This is the 2nd part of the 2nd problem. It appears that you don't have that $1000 deducible either.

You've filed the claim under your Farmers policy for two reason's... they can address your loss without the liability issued associated with the other carriers (and trust me, there are issues). But this also means you need to come up with the amount that you _choose_ to be self insured for. This is that $2000. As I mentioned, electing for these deducible amounts and not having the ability to address them is a problem you've created.

Bristol West is in a tough situation as they need to protect their insured (the driver) but because that person elected to have minimal limits, they don't have enough money to pay for your loss. But they still need to protect their insured. So they are going to to need to wait until Farmers submits all the paperwork on the loss and they are going to require Farmers to sign a Property Damage Release. They are going to pay all of their money to Farmers and only then will Farmers be able to credit you back _part_ of your deductible amount.

Next is Allstate... Allstate is going to need to sign off on a few things but will also need to wait for Farmers documentation as well as Bristol West's. Once they have all this, they should be able to issue a payment for the difference. Once Farmers has this money, they can refund the rest of your deductible to you... but it won't be until all of this is settled. I hate to say this but this could take 3-4 months.

This is one reason why people should have collision insurance and when they choose their deductible amounts, choose amounts that they can afford to pay. What good is having coverage if you elect a deducible so high that you can't afford to pay said deducible? _That_ is the real problem. It's unfortunate that someone else caused damage to your vehicle but it's not their fault that you elected for $2000 in deductibles.

I don't see that you need to come up with the $2000 by the 20th. It sounds like your regular lien payment is due on the 20th. I'm guess this is not $2000. Speak to your lienholder and I'm betting you should be able to make a payment, as your lien agreement calls for, and not suffer any penalty.

You were upside down on a 1999 Corvette with super high deductibles... trust me, you were in debt before the accident.

Just so you know there was no deductable on my Gap insurance. Farmers took the 1000 deductible out of the payment on the lein. In final payment Gap (ownergaurd) took out of what was paid to the leinholder the last payment that I did not make after the accident , late fees , and the 1000 deductible that Farmers had already taken out (again there was no deductible on my gap). Again this accident was not my fault, so why is my deductible even an issue? I had full complete insurance coverage (collision,liability, property 50/100/50 . What was I paying for?

Your policy states that they will pay the less, less your deductible. If you were to file the claim under the other person's policy you would not be subject to a deductible. But in the end, once Farmers recovers the amount they spent, your deductible will be refunded to you.

If there is no deductible on your GAP insurance it does not make sense that they withheld another carriers deductible. Perhaps you need to call them and discuss the situation with them.

Have you spoken to your lien holder about this mistake? You can also let them know that your GAP carrier did not pay the correct amount. But again, I don't see why a GAP carrier would pay less your carriers deductible amount. Is there a possibility that your payment plus late fees might have accounted for that $1000 that you mentioned?

In the end, once everything gets worked out, you should recover 100% of your loss.

Unless the OP has quit maying his payments (car/loan) all together...OP is that it? Have you FAITHFULLY continued to make these payments although the vehicle was totaled?

Because you used your collision coverage...anytime you use your collision or comp coverage the deductible THAT YOU CHOSE, must be taken...has zero to do with fault....

You were paying for protection which is what you got...

T, most gap coverage/policys/payments I've seen do not cover the property damage deductible...for instance...loan is 10k...value is 8k minus 1k deduct..p&c pays 7k, gap picks up 2k not 3k...so the owners still have to pay that deduct...gap covers the gap, in the value verses loan, not the p&c deductible...(again in the ones I've seen pay)....

The at fault carrier (Farmers?) that has money left ( :roll: ) should have paid this 1k deductible by now...HOWEVER, I don't understand the other 1k...unless it is for these ''out of pocket'' expenses you are talking about....sounds like you need to call farmers and ask about your deductible..it may be easier to call your carrier/adjuster and see if they have received payment from farmers yet...most times they will reimburse your carrier who will then reimburse your deductible to you...it could be laying on someones desk....

Again, if you can and are so inclined...what is this second 1k? You talk about late fees etc? What's that all about? You can't expect that any of these carriers would be liable for your not making the payments right? Also you say,
