I am in the state of louisiana and would like to find out how much I may get I had a lawyer and a medical bills

Not sure. It really depends on alot. Your type of injuries,lost wages, any disabilities..soo much goes into consideration here. I know one thing that they will not include and that is any lawyer fees. It was your decision to hire the lawyer and not theirs so that will not be considered in your settlement. Someone else may have a better answer for you but I imagine they will need a lot more information than what you listed.

The lawyer would take 1/3 of the settlement amount as his consultation fees. You should discuss the settlement amount with the lawyer and as fireyone has mentioned, you are entitled to receive compensation for the prescription drugs, doctors' visits, therapeutic treatments and other medical treatment, wage losses and pain and suffering.

But they definately do not reimburse your atty fees. Think twice about getting an atty if your case is pretty open and shut. Sometimes they drag all this stuff out forever. Most will drag it all until it gets near the SOL for filing suit. This is what mine tried to do.

If memory serves and nothing has changed LA has only a 1yr statute, that's why everyone gets a lawyer and everyone files suit...your lawyer that you are paying a full 33.3 percent of YOUR MONEY should be able to tell you how much they plan on you getting...what have they said? why 'type' of injury do you have?

There is an up side to a one year SOL in my view. First it doesn't take a long time to settle and secondly think of how the person who hit you feels (yes they have feelings too) waiting around to see what will happen.

But the down side is, and it's a big one, nearly every bi gets a suit filed to stop/stay the sol. which then allows it to go on for nearly ever.

OOHHH You know I really didn't think of that. I guess that really is a big downside. Maybe they should put something in place that says a case has to be over and settled in a certain amount of time..not stay the SOL. That way both parties involved in the accident can move on with their lives and just let the past be the past.

Of course that's the purpose of the sol,

Only trouble is a majority of moderate to severe injuries can't resolve there selves in that year...thus the staying of the statues...when you file suit though then the judge periodically makes everyone appear and give direction on getting it settled.

Okay I can understand that. I just can not see a case dragging out for 3-4 years. There has to be a way to resolve. Is this when the judge enters in the picture?

yep, I seen judges get just as frustrated at it dragging out and say, (in effect) get this settled in 30 days or I'll settle for you and no body's gonna be happy then!
