my son got hit on his bike in a cross walk by a driver and the driver and her husband refuses to give us their insurance. what can we do

Well, I'm wondering if a police report has been filed already? Were there any witnesses? Lets see what our senior members have to say regarding a possible way out or a solution once you share this with your insurer.

I'm sure we've had quite a few discussions in the past wherein the at-fault party refused insurance information.
I'm sure you have their license plate no. So, now take the help of the police. If nothing works, consult with a lawyer and file your legal suit.

(Just 'throwing this out there')...I'm wondering if the other driver didin't WANT to give his Insurance info out..because (possibly?) he didn't HAVE Insurance. I've seen situations like this. Hopefully you DID get the Lisence plate number, etc and you will go to the police. Is your son ok?

At this point it seems as though it might be too late to file a police report, unless you got some information about the people. Did you get a name or license plate number?

I would definitley contact the police and assuming you have the drivers contact information, I would contact an attorney and have them work on this for you.
I hope your son was not hurt too badly. Best of luck.

I'm simply at a loss. It's required by law to exchange contact and insurance information after an accident. If the person refused, you simply call the police. If the person leaves then its a hit and run involving an injury... usually a felony.
As mentioned, when someone refused to give insurance information it almost always means that they don't have insurance.
While the loss is now suspect (as for some reason it appears this was not reported to the police), you can go down to the PD and complete a report at this time. I'm not sure how insurance information would work.
You can always contact an attorney to pursue the matter.
Does anyone in your household have auto insurance? Depending on the state some of your son's medical bills may be considered under that policy.

OP.....if you didn't get contact info, by now, I really don't think you could find them (unless you happen to KNOW who they are, 'personally'). As people has posted above,.yes..you CAN go to the Police Department. I really don't think they can do anything at THIS point, though. :cry:
