California/Nevada MEDPAY Subrogation Laws

Did your attorney tell you anything specifically? I have this feeling like they're right in saying that you'd need to follow Nevada's guidelines. Still, I'd wait for the senior members to come and share their views in this regard.

Just to verify, (before I give you my opinion) we are talking about medpay subrogation right NOT health insurance correct?

Yes Lori, it's about auto medpay subrogarion. My policy is in California with progressive and the accident was in Nevada. Do the laws of "double dipping" apply or will the California laws apply? Like i said above, I called Nevada and California insurance commisioners and they said they should go by the states guidelines whereever the accident happened. My attorney was unsure still which makes me nervous. Thanks for responding.

ALL auto policys must conform to the state they are driven into...as an example, I have a MO policy, if I drive across the river into KS and get into a wreck, all of a sudden I also have PIP..(MO does not even sell PIP)...but because the accident occured in a PIP/No Fault state, that is how the claim will be handled, and the coverages will be afforded. My opinion would be that NV would take presidence, UNLESS your policy says something to the contrary...Has your attorney actually read your policy?

Has progressive said they still intend to subro your med pay?

I spoke to my attorney a week ago and she wanted to look at my policy since I was not the driver. The driver didn't have medpay so I decided to use my autopolicy. She requested my policy from my insurance to look it over. I'm going to give her until next monday. Should give her enough time. BUT I called my insurance and they said they would not subro the medpay but my attorney said she still wants to double check because they are not progressives attorneys who told me that they wouldn't subro. Any suggestions? :shock:
