Victim of hit-n-run receiving no coverage

OK, here's the story. My 2004 car was hit and completely destroyed. The driver left, leaving no information, so it was a hit and run. The police eventually found him and took my vehicle and his to do the forensics on both vehicles. i phoned my insurance to let them know the next day, I do not have collision on my vehicle also. It took the police a week to get back to me and when they did i called his insurance company, it turns out he was canceled from his insurance company, so he had no insurance. I phoned my Insurance representative and told her the story, she said that my insurance company will cover me completely, she knew the whole situation and still said this. She said the adjuster would be in to look at my car (this whole time i was paying for it to be in the impound). It took them 2 weeks and i never heard anything and when i tried to call my insurance they wouldn't talk to me i would only get an answering machine. They eventually called me and said they would not cover me even though my representative had sent in this claim and had it approved. I waited anouther 3 days with no information, and once again they decided to not cover me. My representative gathered information on other company's that would have covered me even with this happening, my mother and brother who have there house 2 houses and 6 vehicles also insured by them said they would leave if they did not cover me. They still decided not to cover me, is there anything else i can do, im only 21 and dont know to much about things like this and do not have enough money to talk to a lawyer. I am now out $13500 and dont know what to do

OMG!! Horrible..just horrible!! I'm sorry to hear about all of the problems with the insurance company. Did I misread your post, or did you say, 'at the beginning of your claim, that the insurance company WOULD cover things?...now they WILL NOT? Gosh........terrible. I'll tell ya what..I'm not the forum's 'expert' on such matters, however.....ONE of them will be along shortly to give you some 'direction' to go. I just wanted to say "Hello" and please hang in there.

That is correct. The insurance company initially said they would cover me then 2 weeks later decided to change their mind

Well, I think you have to re-read the policy document to know what you're covered for. You need to have either the collision or the uninsured motorist coverage (UM) to receive compensation form the insurer in such situation. If you haven't opted for any of these coverage the insurer may not cover you for the damages.

You have mentioned that you don't have collision coverage. Now, do you have uninsured motorist coverage on your policy?

Which state are you from? Is suing the other driver for the damages an option in your state?

Well, Jeremy, while I think that the insurer might have a definite reason to deny OP's claim, his following statement has boggled my mind

My representative gathered information on other company's that would have covered me even with this happening,

What does the above statement mean, OP? Is your insurance agent (I'm assuming that by representative you are referring to the agent) saying that you are entitled to receive coverage for the damages caused to you? Does this mean that you have uninsured motorist coverage?

Have you received the written claim denial letter from the insurance company? Let me tell you that a claim isn't officially denied till the time you're served with the proper denial letter.

Who you are dealing with so far about the claim? Have you had a chance to speak to someone at the claim's department?

she said that my insurance company will cover me completely,

First who is ''she''? What is her job? What insurance company is this and in what state?

Have you received a written denial letter from your carrier?

I am now out $13500 and dont know what to do

HOW is that possible? How can you possibly be out that much money?

Regardless of what the 'rep' (and i need to know exactly what this persons job is) told you YOU knew you didn't have collision coverage...do you by chance have Uninsured Motorist ''PROPERTY DAMAGE'' coverage? Look at your policy...This may come down to you filing a small claims suit against the other party...that doesn't require an attorney...what do you know about this other person? Do they work?

"" My 2004 car was hit and completely destroyed. ...""

$13,500.oo sounds reasonable. There must be hundreds of Thousands of automobiles on the roads worth that much and more. Especially when one factors in the potential Towing, Impound Fees, Rental cost, etc.

No, Fred the reason I'm wondering how it is possible, is he carries no collision coverage, thus no lein holder, and from the op's post it doesn't sound like he would own a 13k vehicle that's paid for..could be a leap on my part, but without knowing 'which' 04 vehicle this is...i have to assume he's talking about damages, AND towing and storage? maybe? I just don't see from the post where the 13k comes from is all

Please inform me of something...........how do you use your Home Line of Credit to purchase a car?? Do you use the home as collateral? I would think the only way you could do that is if the home is ALREADY paid off........i don't know, just a guess.
