I recently had my car hit on the street. The driver left her information and an adjuster came out to look at the car. He gave me a claim check in my name based on his estimate of the repair cost. The truck is old and beat up and was on the for sale market before it was hit. Is it fraudulent to keep the keep the claim and sell the truck?

You suffered a loss. That loss was paid for as required. Done deal. Someone may offer a little less because of the damage so the check will offset that. But in reality, depending on the age and condition of the truck, the reduction in price will probably be much less then the check amount. But that does not change the fact that the insurance company owed for the repairs.
