Personal Injury Claim

I was in a car accident a month ago. My right elbow was fractured and I was 7 and a half months pregnant. I cannot work until the elbow is better. I underwent extensive fetal monitoring and the baby is fine. I also had 2 kids in the car (one 6 and one 2). Both were physically fine. The insurance company wants to "settle on the kids" (we won't settle on the rest until after the baby is born). They are offering 750 for the 6 year old and 1000 for the 2 year old. Since then the two year old won't sleep in his own bed, is hysterical every time I leave the room and wakes up with nightmares all night long. Should we settle on this amount for him? Any other advice for the settlement of the rest of the claim?

Hello Kf9064,

The settlement amount sounds fine to me since none of the kids were seriously injured. Has this amount covering all their medical expenses? If so, IMO you may settle for the kids at least.

Any other advice for the settlement of the rest of the claim?



Yeah, don't settle till the baby is born and your elbow heals. Have they made any settlement proposal yet?

It's natural for a kid to go through shades of trauma under such circumstances. So, I don't think it's a big problem, as it's gonna come down with time.

Do you have medical docs supporting this? Also, you'd need to think a lot on how much you're missing in terms of your earnings. So you'd better take your time at that.
