My insurance agent from Nationwide called to tell me that my policy was in danger of being cancelled because of lack of payment. (My ex-wife was responsible for making the payment per agreement but that's besides the point) I decided that it was time to get my own separate policy and asked the agent to call me back with quotes before the end of the business day. She never called me. I called Progressive, found a great deal and got a new policy with Progressive. The next day my insurance agent phoned me. I told her that I had opened a new policy with a different insurance company. I now find out that there was a lapse in coverage of a few days and am being penalized. As far as I knew, according to the information given to me by my agent, there wasn't any lapse at all. How can i prove this?

Nationwide should be able to give you documentation showing you the cancellation date of your policy.
Compare that to the start date of your Progressive policy and you will see if there is a lapse.

Was their a lapse? Your not clear. Need to know the answer as it changes your question. That is, how can I prove that there was no lapse, as there was none or how can I prove that my agent told me there was no lapse, when there was one.

I think 'maybe' i get it..had he renewed there would not have been a lapse (ten day thing probably) however since he did not renew there would've been a lapse.

Is it possible to get a new policy with a lapsed policy in record? Does it affect the price?
Is there a chance that the new carrier may decline the coverage since you haven't settled with your pervious carrier and had let the policy lapse for non-payment of premium?

You can buy auto insurance anytime - regardless if you have some in force or not. Of course, coming to an insurance company without insurance already in force will cost you.
It's possible that the OP told Progressive he had insurance in force. After the policy was written, they went to verify everything and discovered that the insurance wasn't in force; it had canceled a few days prior.
They will adjust the premiums accordingly.
Again, get copies of the old and new policy and compare dates.

my car was stolen a week ago, of coure i called police then i called my insurance company .during my conversation with my insurane i was told there was a laspe in coverage which i was unaware of i made payment an reported claim now im being told there is nothing they can do for me. is there anything i can do

No sorry Nikki if you let your policy lapse and had an loss while it was in lasped status, no there is nothing they can do.

i was hit by a vehicle (auto-ped. accident)
The lady who hit me said she had insurance. I was assigned a claims adjuster but later there was a letter given saying the policy had been cancelled on a certain month & day. On a previous random phone call it was told by the insurance company that the policy was cancelled two months before the date mentioned in their letter. The lady insists that she had coverage and that her policy is still in force. I have researched this company to find they had been fined, not only in MO. where this accident happened but also in IN for not properly handling claims. Is there an agency in Missouri that can verify if she indeed was covered or not?

You need to file a complaint with your states Dept of Ins office. Let them know that you have been given incorrect cancellation dates and that you think the policy is still in-force.

One would expect that there would need to be some written correspondence to the policy holder establishing withdrawl of cover?
Are they saying she stopped paying? If so it should be pretty easy to clear up. If it truns put that she did let the cover lapse, you will have to go after her personally for any damages.
