Car Accident

Hello, I was driving through a very tight one way neighborhood street & this lady was standing next to her truck fixing her driver door I passed slow & I know she opened her driver door more so I could hit it while I passed. She then started yelling at me cussing I stopped & parked in front of a house & talked to her I told her it is not my fault you opened your door & did not move she told me you better have insurance or I am going to sue you. I had my four kids in my truck it was very hot & humid I then gave her the number & name to my insurance not the policy number & she told me I will call monday I gave her my cell number & she has been calling me everyday telling I have to fix her truck & what is my policy number can she sue me? She does not have insurance & we did not file a police report she has been harassing me what should I do?

Well of course she 'can'...

She does not have insurance & we did not file a police report she has been harassing me what should I do?

Honey you need to turn this into your company ASAP They will investigate it, and in all probability deny her claim, that's their job, to investigate it, determine liability, and protect you...Failure to report a claim in a timely fashion 'could' cause you dire consequences (they could deny coverage, probably won't but could)...Get on the phone right now, and report this claim! Tell the lady next time she calls you that you have reported the claim to your carrier, and you have given them her information, and she is not to contact you again. Your adjuster (not agent, don't call your agent call the claims report line), will handle everything from here on out...

Your first mistake was not to file a claim with cops.. Well whts done is done...but the next step would be calling your insurance and give the matter to them.

Reporting to the cops is not always a requirement. In some states if the accident happens in a private driveway the cops won't get involved if no one is seriously injured in it. Again, some other states have a monetary threshold, which doesn't require all the accidents to get reported to the police. Anyway, I agree that Raylen should inform her insurer ASAP.

Raylen, which state are you from? How much damages has she suffered? Was there any damage to your vehicle?
