Denied Claim, Conflicting Storys-50/50 loss

I had an accident a month back. The accident was no fault of me and it was clearly stated also in the police report where the other driver even admitted it and was given a ticket. Now after 1 month he gives a new fabricated story accusing me of the accident. The insurance company send me a letter denying the claim. How can i resolve this without going to court. :cry:

Any help would be highly appreciated.



United Automobile Insurance is the Worst Insurance Company........god willing the adjuster Alysha Rodriguez-Alba is going to hell for doing this to me.

I assume that you already contacted the adjuster’s supervisor, if not do it. If you have and they are still going to deny your claim, there really isn’t any other recourse then the court system. Depending on the size of the claim, you could do small claims.

That said, Alysha Rodriguez-Alba is not the problem. The problem is that their insured changed their story. Depending on the circumstances the adjuster is going to back their insured unless information is provided to prove them wrong (independent witness), and no the police report doesn’t always count.

I'd agree with Das's suggestion. Talk to the supervisor of the adjuster. Do you have documents that would support your version? Do you have auto policy? And, if so, have you contacted your insurer yet?

Further, what United Automobile has stated as its reason for denying the claim?

I finally contacted the insurance commissioner and now the adjuster comes with a new reason for denial in the letter they sent to the insurance commissioner.

I used to be an insurance adjuster and there is a difference between receivng a ticket at the accident scene and determining legal liability for the damages incurred and determining who is liable. Just because one party receives a traffic ticket for a violation does NOT make them legally liable for the accident. Maybe you need to find out EXACTLY what the reason you were denied rather than wish someone to hell. Sounds like you need to do your homework. Reread Dasfuk's post...it more or less says the same thing.

File a claim with your insurance company. They will probably do a better job in helping you resolve some of the issues.

Only the OP was demeaning you. Care to share your side of the story . . . beyond "I was just doing my job." ?? It might prove valuable to all of us. Were you doing what you were "told" to do, or what you believed was the correct thing to do? Or were they one in the same?

There is a persistent belief that adjusters only do what they're told to do, not what they know is the right thing to do. We have members here who are/were adjusters who tell us that they usually went out of their way to do what they knew was the right thing, regardless of whether it saved the insurance company any money or not.
