how long can I be compensated for loss of use

My car was declared " Total " without proper estimate. My car was un-drivable. I was not given a rented car by the at-fault's insurance company. I don't have extra money for renting a car. It was a Hit and Run but the driver was found. there was a witness who provide the license plate. How many days should they compensate me? :(

What do you mean by a 'proper' estimate?

Re: rental vehicle...the at fault party's carrier would owe you a rental or loss of use, from the date of loss, or the date they were made aware of it, until 48-72 hours (some carriers/states are longer) after making an offer of settlement for your total loss. If there was a reason that they didn't or couldn't accept liability for some time. Then they may not owe you until they accepted liability till an offer of settlement was made. Don't confuse 'offer' with 'acceptance'

A few questions:

What state are you in?
Did they not offer a rental? Did you not request one?
Have they made an offer of settlement?
Do you have collision coverage with your own carrier?
Do you have rental with your own carrier?

Hi Jowalay,

I somehow have got the feeling from your post that the matter has already been settled by the insurance company. Is that so?

How do you know that the estimation was not proper? What have you done about it?
