My medical report shows that I got discharged in 3 days. I waited for 1 more
week since I had a few sessions left with a therapist.
The HR help-desk had stated that this would be counted within my medical
leave, but now they've deducted a week's pay!
A number of things have remained unexplained - please help.

What is your injury? was this a work comp or auto accident. Have you contacted HR to find out why this happened? if this is an injured caused by the negligence of another, do you have a claim with that party's insurance company? If so have you already settled it?

I am suffering from whiplash injury.
I have stiffness in my neck which again is associated
with intense pain.
The mishap has been communicated to my insurer, but
I'm not sure of the proceedings at their end. Last had a
word with the HR person (2 days back) and he had
promised to keep me updated.

I'm so sorry dear..I just forgot to mention that it's an auto accident.
The HR people are yet to offer the lost wages document that was supposed to disclose the fact that I couldn't work for the same period that I got treated for. I guess this has happened since my medical report bears no explanation of that 1 additional week.

Ok this makes a little more sense re: why HR is involved.The insurance carrier (for the at fault driver or PIP carrier which ever), will only pay you for lost wages that a doctor will support...They will then need a form completed that they should've sent to your employer...so are you saying the doc reports took you off work for say a week, but you missed two weeks? And are you saying that your employer has failed to completed the forms and return them?

Absolutely!

Yes, I missed an additional week.

The insurance company is liable to pay for the lost wages provided you have proper documents. If you are unable to get a doctor's report for the same, the insurance company cannot be held responsible for the payment.

Ok, the insurance carrier most likely will not pay for that additional week you took off...Unless a doc said 'blunt cannot work for two weeks, due to this accident' You're not going to get those..if he said, 'blunt cannot work for one week' they'll pay that.As to your HR dept not completing the forms...just march right in there ask to speak to the head of HR and ask what's the problem here?

I was with the same therapist that the doc had referred initially. Won't it help if the therapist gets it in writing that I was in need of therapy for that additional week?

In need of therapy and being taken off work are two different issues..
