I was rear ended. They have already paid to have that fixed. I'm trying to settle for my medical. They won't budge. My medical was around 2200. Most of which is either a lein to the chiro or must be paid back to my insurance co. Out of work was $500. Their offer was $3500. I think that is low. Am I being too greedy? I asked for 6k and he told me I needed to go out and get an attorney because he had been doing this for years and the damage to my car just didn't warrant this kind of settlement. This is their second offer. His original was for $2000. Any advice? I just don't agree with the offer.

There is no way to tell you what amount the claim is worth. There are just too many other factors to consider. With that said, yes it might be a little low but I'd say it's probably close to what you can expect.

Paying back to your insurance company? Health or auto. If auto, what kind of PIP coverage is in your state?

Have any of these other parties actually sent in liens to the other carrier?

The insurer might not take the chiro bills too seriously. They are known to inflate their bills. May be that is why the insurer considers it offer sufficient to cover all your medical expenses.

Tcope has pinned it right, you must clarify if your health and medpay insurer has already contacted the insurance company for recovery. However, IMO, it never hurts to negotiate bit more. It might add couple of dollars more to their offer.

Yes, if it's an auto insurance claim, then it may have something to do with the coverage norms in your state. Negotiating more doesn't always guarantee a better settlement. You'd certainly need to have a justified ground. Once the offer seems reasonable, letting your claim through any unwanted investigation would delay the settlement process.

If I read your post right, the incident has cost you $2700 and they have offered you $3500. I don't know all the details of the accident, but it seems pretty fair to me.
