If I saw the driver that caused the wreck how can she be a phathom. She merged into traffic without yielding at the yield sign, which caused me and two other cars to try to miss her, we did, but I hit the car in front of me. She then left the scene and had to be brought back by the guy behind me. I am told by MY insurance rep that she would not be held responsible and that I will be responsible for the car that I hit. Is there anything I can do?

Find out why your carrier is under the impression that she is not liable. It probably has something to do with no impact and perhaps the negligence laws in your state.

It is because she made no contact with anyone. However she caused the accident. I am the only car that hit someone. It was hit them or swerve into oncoming traffic, nowhere to go on the right.

While all the facts are not known it's unusual that in this situation your carrier would not be trying to place some negligence on the other driver. The fact that someone does not just swerve for no reason should be enough to place _some_ blame on the person who drove away. I'd recommend that you speak to a supervisor and see why they are not trying to put any liability against this other person.

Have you had the number of the other driver? If you can provide the insurer with the information they may try to locate the phantom driver you are talking about.
The reason for the insurance company not believing you could be that she wasn't involved in the wreck. She might have drove away from the scene but she actually hadn't caused damages to any vehicle.

Have you had the number of the other driver? If you can provide the insurer with the information they may try to locate the phantom driver you are talking about.
