I have a case pending right now and they are trying to tell me that open ended medical settlements are non existent. I don't think that this is true and I dont' want to sign anything without knowing. I still have issues with my back and need more surgery but if i settle, I"m on my own paying the bills .....help!

I guess that you can't be forced to settle a claim until you are ready to do that. If you still require medical assistance, you should tell the insurance company that you are not yet ready to settle the claim.

Also you can estimate the future cost of the treatment with the help of your physician and present the claim amount before the insurer.

Thanks,
Rupert

Could be that some states do not have 'open ended releases' I personally have settled many a claim with them in my state (MO)...I would caution you though if you are certain you will require surgery then wait till it's over to settle.
