will family fall apart

this is in florida.
I have 2 friends there 2 sons was in a car accident the passenger died. the driver was driving his girlfriends car, the passenger was wearing his seat belt. when the police arrived at scene both were out of the car. the driver pulled the passenger out. which was already deceased. the police think the passenger was thrown from the car. the driver has a driving record which has made him lose his driver license 2 times already. car insurance company's from the deceased family paid them 5000. the drivers girlfriend car insurance paid 10000, the drivers parents insurance wants to pay 25000 which either of them is not going to be cashed nore the paper work signed. is that what insurance pays? what can they expect will happen to the driver? BAL was a little below legal limit on the driver. the driver brags he will only lose his license for about 5 years no big deal. because the family part. the sisters have been pretty close over the past 4 years but the sister that lost her son hates the driver. also will the entire family fall apart over this. any helpful information will be grateful.

Sorry, I'm at lost :? I don't think that I've understood the problem properly.

The driver and the deceased were family members, right. If not then the deceased must get the coverage under the responsible party's auto insurance. The driver can't walk away from the liability and he is required to compensate the deceased family for the loss. The claim should be turned to the insurance company of the responsible driver.

Well, some insurance company may put an additional clause in the comprehensive coverage that it'll compensate if the co-passenger and/or the household member suffer injuries or death in an accident. If this clause is included in the policy document of the responsible driver, you may get the compensation.

Your post makes no sense to me comprehensive coverage has absolutely NOTHING to do with this OP AT ALL...

any info, sounds to me like all applicable coverages are paying their policy limits which all the insurance companys CAN pay..the family of the deceased can sue the owner of the vehicle and the driver but the judgement isn't worth much if they don't have anything...the driver is a bumb (IMO)....will this tear the family apart? More than likely...what can you do about it? nothing...be supporting and loving to those that have lost their family member. stay away from the 'punk', just my opinion.

I have been friends with this family for atleast 25 years. i love them as if I was family to. i would like to give both mothers good advice. I did tell the mother of the deceased I wouldn't sing anything either if it were me. (talking about what the insurance companies has sent them) A check and also a letter saying when she signs it that that would release the owner and the driver of any claims,(that is the car owners insurance and the drivers parents insurance) also all this was done 2 days after the accident.

yes it is 2 sisters and their 2 sons. any info on the insurance part is grateful. and any info on what usually happens in cases like this with the driver. will be helpful in talking also to the 2 sisters. thank you

All the carriers have are their limits to pay and no more no matter what they do...since they are sisters, then the one should ask the other what are your BI limits.

Lori, I've read somewhere that if the passenger lives in the same household and is listed in the policy of the policy holder, they might not receive the coverage under the liability insurance of the driver. Is this true?

Would this clause affect the recovery of loss for the deceased's family?

In some states that's true, my state for example did away with spousal ammunity years ago, so if I'm a passenger and my husband driving rearends someone injurying me although I'm a named ins I can still get a BI settlement which IMO is stupid...hello collusion...but anyway it depends on the state.
