I was passenger in a serious auto wreck. I had a traumatic brain injury amd incurred over 40,000 in medical bills. My lost wages were around 2,000. My lawyer sent in a demand for policy limit. how much is a fair amount and how long will it take to get a decent offer?

No way of telling what a fair amount is given such limited information. But I'd expect if the policy limits were $100k or less then you'd probably be offered the policy limits.

The owner had full coverage on a fairly new car. What other info would you need to help?

Unless full medical records were reviewed, it would be impossible to give an accurate amount. Policy limits would also be helpful. An attorney can ask for policy limits or even a million dollars, but a lot really comes into play as every claim is different. Traumatic brain injury is a little vague as well. It sounds bad, but is still vague. Other things that come into play: are your injuries permanent or semi-permanent? How many other people in the car were hurt (how many people are looking for money compared to how much money is there)? At face value of the limited information given, I would agree that they would pay policy limits many times, but it really depends on other factors.

Im only 1 making claim. Injury is semi permanent hematoba to frontal lobe with nerve damage to neck.

I ment to say that I agreed with tcope that they would normally offer policy limits if they were 100K or under. If they have 300K then no.

You have already taken the initiative by sending the atty's letter to the other carrier. If your claim is going to exceed the policy limit of the driver, they in all probability would disclose the limit to you.
It may also depend upon the state's practices. Some states don't really require the adjuster to disclose the policy limit of the driver to the claimant.
