My friend is disabled and

My friend is disabled and can't afford insurance on her vehicle. Well 2 years ago she was involved in an accident she was hit on the side by a lady who claimed responsibility and gave her all the contact and insurance information. My friend didn't call police-the person came out of a do not enter, crossed 3-4 lanes of traffic. My friends fiance was the passenger in her vehicle and the other person is still claiming their innocense-If my friend's fiance is injured and he sues his gir-will she get into trouble

Are you saying that her fiance wants to sue this woman, 2 years after the accident? Did I read that correctly? You said she is Disabled: What 'limitations' does she have to be Disabled? Not trying to be harsh, I'm just trying to found out the facts. Did her Doctor 'label' her as Disabled? Was the fiance hurt in the accident?

I would not think that it would have anything to do with her if the other person was at fault, the at fault person's insurance company would have to pay, but I am wondering why they waited for two years, there maybe some type of statute of limitations involved here, how can you prove all the facts and a person can do a lot of damage by other means in two years time. How do you plan on proving any of this?

I think her fiance will have a hard time two years later trying to prove that the injuries happened in the accident. Should have been taken care of a lot sooner than this. Was the fiance doctoring for two years? I think the insurance company would refuse to entertain this case.

Wait for one of the adjusters to come along and answer, they work the field everyday so they will give you some good advice here.

OP, I gather that if your friend has caused the accident the passenger can sue the driver for the recovery of the medical damages. However, since the other driver has caused the damages in this case, the passenger is required to sue the other driver for compensation or file the claim with her policy.

Anyway, is your friend still insured or has she allowed the policy to lapse? what is the nature of her disabilities? is she going to drive the car in the future? who is driving her vehicle for the time being?
