How far from the poor side walk to the place the fall occured? How big a chunk of concrete? What kind of injury? Had they told them EVER that the piece of concrete came from a unmaintained area? Do you still have the concrete, and has that bad area been repaired yet? Or did you all not realize that this is where it had come from until recently?
