I have a Ca claim that after the collision occurred, the veh was repo'd. The lien holder has the veh but the title is in the owner and lien holders name. Who do I issue the check to and do I mail the the lien holder?

you write a letter to both and ask them to get a response. And clarify that who would be getting paid... Most probably its the owner you pay

Are you going to issue the check to repair the car or you need to obtain the title too?

The lien holder still has the veh. I am not sure if the veh is going to be repaired but a few repairs were previously made and the lien paid for them. I don't know if they are willing to work with the owner to keep the veh. It is not a total loss

Alisa, I'm little confused, from your first post I had the impression that you might be an adjuster who wants to know who to include in the claim check. The following comment might have sent me off the track. :)

But now I think that you are the owner of the car, is that true?

The lein holder will get the payment for the damage, minus the deductible. They may or may not repair it.
I handle about six or so of these a year. Car is re-popped. Leinholder turns in a claim for the damage they found once they got the vehicle. I go out write an estimate on the damage, pay the leinholder minus the deductible.
Most probably its the owner you pay
If there is a leinholder on a vehicle they HAVE to be protected (on 1st party claims)...If they have re-po'd this vehicle chances of it going back to the owner are slim.Posted: Fri Jul 10, 2009 04:23 pm Post Subject:
This is a third party claim not a first party claim. But since the claimants lien holder has the vehicle and has paid for partial repairs. The veh was at a shop prior to repo. So I am concerned on paying the claimant only or lien holder only.

If I were concerned about this, I'd put both names on the draft, and then mail it to the lein holder. I probably wouldn't be very concerned however, and I would pay the lein holder only and direct.Add your comment
