i was in a car accident on december 26,2008
this lady ran right into the back of me.my car is a 2008 honda accord,i have an attonery but i want to know if i am been cheated please let me know.my medpay paid for my dr.the insurance company the lady is with is usaa,o by the way my injury is a soft tissue injury.so far my lawyer told me that they have put in an offer for 4225,00 people on top of that she has to take out her 30 percent.am i been cheated?????I feel like i should be seeing at least 10,000.am i been greedy?i really feel that is to low.PLEASE EMAIL ME AT Modelkrb[at]yahoo.com

There is no way to know if that is a good demand/offer. We no nothing about the accident, the injury, the medical treatment, etc.

Your attorney is going to charge you 33% of your settlement, not 30%.

A wild, wild, wild guess would be that I doubt you'd get more then twice your meds on a soft tissue injury.

my medical bill totaled 3,692.34.the lady that hit me ran into the back of me,she wasnt paying any attention causing me to experience lower back pain
after she ran into the back of my car.i had to go to the chiropracter for 3 months,it started off with 3 times a week and it gradually went down to once a week once i started feeling better.

Did your attorney demand $4225 or is that was the insurance company initially offered? If that was your attorney's demand, was that amount on top of your medical bills or does that include all?

Since we haven’t examined or reviewed your medical reports its hard to quote a suitable amount for the damages. And, you are already told the same by the other posters.

Tcope is right that the atty is going to cost you 33% of your settlement, and it seems that after paying her charges you won’t even have enough left to cover your medical bills. Have you let your attorney know that you consider the proposed amount insufficient?

I guess it includes all...so you'd need to deduct her 33% as well. But, I wish this doesn't include the chiropractor charges. So, if that includes all, then it's of no good to you in my opinion.

Yeah there are to many things missing. However if that is the amount that the other persons insurance co is offering your attorney should seek more if he or she feels you deserve more, which you probably due. Your attorney is going to take somewhere around 33% of any amount you get considering if they work off of that system. It is a long process, I know, been going through it for a while now.
