i was in involved in an accident that i believe is not my fault, but not sure if i will be held responsible with the insurance company.
here is what happened:
i came out of a gas station. In front of me there were oncoming cars, who stopped for me to cross them and turn into the following lane going the opposite direction. I stopped pretty much in the middle of the road, a car from that direction stopped as well. I said thank you to both cars and made my full turn. I went slowly because of the traffic and because of a car in front of me waiting at the light. I was stopped, but inched forward to straighten out my car better (i have a long front end, a camaro) And a car passed the car on the right that let me go into their lane and hit my front right corner (right on the side where my blinker light is) on their driver middle door. A few feet ahead the road does seperate into two lanes to turn left and one to go straight (she was going straight i was going to take a left) but i dont think that should matter regardles. Why should i have to worry about 2 or 3 cars behind a car that lets me go. But does she still technically have the more of the right of way than i do?
Trying my best to explain this in a way that i can prove its not my fault, even the guy she passed on the right threw his arms up and was like wtf!? cuz she came flyin by him and was all apologetic for speeding and was in a hurry, but i know when it comes to insurance she's guna say it wasnt her fault obviously. It was very minor damage, under $500 so no police repot, just a chance in info by the officer. Also no witness's but either way there was no repot, so hows this looking for me?

"IF" I'm understanding the facts of loss this is what we refer to as ''the wave of death'' claims...people stop and wave you out, but another vehicle in a lane of traffic smacks you...you're at fault 100% sorry...(if I'm understanding it right)...If that person was driving in a driving lane and you are entering traffic they have the right of way...doesn't matter they were passing on the right as you said...the rules of the road are very clear on this..you cannot enter a roadway until it is safe to do so...you should NEVER accept the 'wave of death' unless you can see ALL lanes of travel...(we've all done it...but if you can't see all the lanes clearly not a good idea as you now know)...hit my front right corner (right on the side where my blinker light is)
The point of impact also shows you did not have 'possession' of the lane...your nose was stuck out into this lane...Why should i have to worry about 2 or 3 cars behind a car that lets me go
Well you know why now...just because some other drivers are nice enough to stop and allow you out, doesn't REQUIRE that everyone else stop, they are free to go around these cars, they don't know why they are stopped....I agree it sucks...and believe me this accidents happen every day, I've NEVER in over twenty years seen the liablity decision be on anyone but the one entering traffic (you)..Trying my best to explain this in a way that i can prove its not my fault, even the guy she passed on the right threw his arms up and was like wtf!?
I know you are and I understand where you're coming from, but seriously doubt there is any way you won't be held 'at fault'..but i know when it comes to insurance she's guna say it wasnt her fault obviously
She won't cop most likely to speeding and really unless she was going about 20 OVER the limit, doubt it would've mattered..Also no witness's but either way there was no repot,
What happened to all the folks that gave you the 'wave'? they were witnesses, (although wouldn't help you more than likely)so hows this looking for me

Just don't feel the situation was that much tempting for you, as you were driving slow. Did you cross over to that lane!
