First Accident, confused

I was just recently in an accident. about to make a left hand turn, oncoming SPEEDING truck hit my front driver side corner of my car. Who is at fault?

Did you pull out in front of the truck? It's unusual that someone would just drift into the oncoming lane... especially right where someone was stopped to make a turn.

If you pulled out I'd say you were 100% at fault. How do you know the other person was speeding? If you know they were speed by watching the truck and judging the distance, why did you still pull out?

I'd like to know if there's something you're missing out. I may only think of getting into such a situation if I was drunk. I'm sure you know the consequences of reckless driving, especially when it leads to casualties.

it can be your fault. you are about to turn left but have you looked first if there is another vehicle on side or whatever places before you do it? if it doesnt then maybe i can directly say that it is your fault.

Frankly speaking the straight answer for your question is................

It is not possible for any layman to understand who is at fault just by reading 3 lines information on it... But the person who is involved in the accident does really knows who is at fault rather cop's will analyze the actual situation and they may be able to come to the conclusion that WHOSE FAULT IT WAS?


I hope that you are in no fault, but if you are then you just need to admit it.Its really simple to solve any problem if both the parties co-operate with it and truthful enough.

^^ i agree! You cant judge directly if who between both of you commit fault with just 3 lines of sentences. In some cases, its either both of you.

In my opinion this question is not related with insurance query.

I think this is your fault in this accident, If you comes in front of truck there is you fault. Don't Forget That always Confirm there are no any vehicle while you making turn or crossing road & beware accidents.

That's probably the reason why a majority of carriers don't assume either of the parties to be 100% at-fault. This leaves an element of doubt (especially when there are no witnesses), since both parties would have had the opportunity to cross the line.

Purpleheaded08 , I tell you that because this is Insurance discussion forum he posted issue not insurance query. Other viz he making turn with out giving indicator to truck who coming from his backside if he give him indicator then there is truck drivers fault.

The answer is somewhat simple. Anyone going straight has the right of way over anyone turning in front of them. That said, depending where you live, some states (such as here in NY) are comparitive negligent states. That means that it isnt always 100%. They split the fault between the parties. If you turned and got hit in the front right side of the car, you are pretty much 100% wrong. The further to the rear of your right side that was hit, the more at fault he was. So, if he hit the rear right side of your car, he had a slight chance to stop because you started your turn befoer he got there. The only thing is that trucks need far more room to stop than cars (because of their weight) and he may not be at fault at all.

Why would you turn left in front of a truck coming at you? That sounds like suicide to try and beat him. It must have been way too late if he hit you.
