Rear-ended and suing for medical and pain & suffering

In August of 2007 I was rear-ended as I was sitting at a stop sign while traveling out of state in New Hampshire and the guy's insurance company acknowledged responsibility by paying for the damages to my vehicle. I didn't realize until the following months that I sustained multiple cervical injuries that will require surgery as well as various other issues like Peripheral Neuropathy, Myofascial Pain Syndrome and Costochronditis. We're suing the guy who hit me for medical as well as pain and suffering etc. My injuries are permanent, there will be scars and lifetime difficulties including physical restrictions, nerve damage into my arms & hands causing a probable loss of work capacity, headaches, anxiety attacks and aggravation of a pre-existing lumbar issue causing accelerated disc deterioration.

You read often about these million and multi-million dollar accident payouts for similar instances that are paid by the insurance companies to settle these claims. If it's intended that the average victim is only to collect based on the coverage limits of the insurance policy, how are these large settlements possible?

Hi Mark

I would love to hear the reply's to your question concerning your accident.
I too have the same question. My father in law was in an accident and the other party and their insurance company took full responsability. He was in ICU for 3 months and had over 20 sergurys. Needless to say he will have a lifetime of issues due to the car accident. He just settled his law suit 2 years after for a mear $500,000. What is up? I too wonder where these multi million law suits happen. Please let me know.

If the policy says that it carries 25000 up to a max of 50000 it means 25000 per person and 50000 max per accident

I received several cervical herniations,shoulder, arm and hand damage. Other drivers policy paid 20,000(limit). we are suing my insurance for my um policy 25/50. Going to mediation this week. Can my insurance company be found negligent for not paying my policy for over two years. I am under constant doctor care, and have mri's and nerve testing showing these injuries.

Can you be counter-sued for asking for too much? Both don't work. They can offer too little, you can ask for too much. No one knows the correct amount until a judge/jury decides. keep in mind, they are _two_ different views to every situation.

What happens when someone had a fender bender so to speak No damage to eat her car both were driven off the scene no injures 4 years later the person is suing insurgence co for $100,000 The car already had rear damage with a bunge holding trunk down!The insurance and other persons lawyer agreed with amount then you had no idea anything was going on until years later that they need signature!!Are the lawyers allowed to contact you personally?Advice on how to handle this stiuation!!

You are asking a question that is beyond the scope of this forum. If you are being contacted by an attorney, you probably need one of your own.

You don't mention in which state this is taking place. There could be a problem with the statute of limitations and the claim has no legs on which to stand. But with only the indication that someone is suing an "insurgence co" why are you concerned? It's the "insurgence company's" problem to handle as they see fit.

On the other hand, if someone is suing you, then you need to contact the "insurgence company" and demand a defense, as your policy entitled you to receive.
