HELP PLEASE

by redsoxrc » Sat Feb 14, 2009 08:08 pm

I have a question. Lets say my son is driving around, and has had his license for 3 months. He is driving with his 3 teenage friends, whos parents know that they are with the driver but don't mind. If the driver were to get in a wreck, who his parents be liable or would the insurance company be liable and to what extent?

pretty much what i am asking is if insurance companies cover your accidents when you break a secondary offense.

redsoxrc,

I read your post, then I read it again, and again....and again....and I still don't get what it is you are asking?

Your teenage son who just got his license 3 months ago is driving around with 3 friends in the car.
That sounds normal to me.

What is the so called secondary offense?

Did I miss something?

What was the primary offense?

If he wrecks the car and it's his fault he's liable. The insurance company is NEVER liable. They weren't driving.... your son was. They will pay your son's liability claim up to the limits in the policy and beyond that the bill will be his/yours to pay...that's Allstate's stand!

Some states have a law that says no minors can ride in a car without an adult for the first six months that a driver is licensed. So the op (and the other parents) are knowingly breaking this law.

Can you rephrase the question?

More useless "Nanny State" legislation.

You should list him as a driver to avoid issues.

Being his parents you really can't avoid his liability if he's a part of your household..could you?
If you're gonna share his liability, then I guess its your insurance that would come to help! Again, the reimbursement would depend on the extent of the damages!

Has anyone heard of a 'Junior License' ( I think it's called)? There are a few of my son's friends, who are 16 years old, but have some kind of 'restriction' on their DL that they can't drive at night. I've never heard of this. All I know is about a Permit ( can get when you're 15 ) and a DL ( can get when your 16).

I don't think i would want anyone else in the car ( besides me, of course) if my son is 'inexperienced' at driving.

Its been a long time since I got my Pa. learners permit (1967) and surely a few changes have occurred, but back then IIRC one could apply for the Learners Permit a month or two before the age of 16 but had to wait until they were 16 before they could begin driving ( only when accompanied by any licensed driver). I think the permit was good for six months. Also one could take the written & road test on their 16 birthday and if they passed both they were issued a valid Junior Drivers License until they reached the age of 18. I think the only restriction was they could not drive between the hours of Midnight and Six AM.

Also there was a provision that if one had successfully completed a State Approved driver training course they could get a regular license at the age of Seventeen.
