After getting into a minor car accident and both parties exchange phone numbers and agreed not to notified the police, both parties left the scene. I contacted the person involved in the car accident and they were in the back of a police car reporting the accident. The officer stated that I needed to return to the accident since I can be ticketed for leaving the scene of the accident. I returned to the scene and was ticketed for failure to yield. Is this possible?

In your particular instance yes, since the cop is the one that told you that you HAD to return to the scene...darn it, maybe if you had not called her back...but more than likely that would've just got you more headache fighting a leaving the scene of an accident ticket...your city more than likely has laws on the books that say you must report any accident to the police that happens on a public road way, I would guess...Have you talked to your insurance company yet? Is the other party presenting an injury claim in addition to the damage to their vehicle, and do you know how much that damage is?

Yes, the accident was reported. The car will be fixed and there was no body injury. Her car is just scratched. Very Minor

good, then your carrier will handle all the damages to the vehicle hopefully they will be very very minor...

I can't tell you how many times I've heard this happening. The other driver convinces someone not to file a claim and then claims it themselves. Listen, if you are involved in an accident call the police (unless private property as they likely cannot help then) and get a report made, exchange all information with the other party. Call and file a claim. Don't walk away without doing that.

I was recently in a car accident I was crossing a road where i had the stop sign I looked both ways and there were no cars coming so proceeded to go. Next thing I know I was hit on the right front side of my car and my car went in a circle at least two times that I can remember. I was taken to the emergency room by ambulance my husband was taking my things out of the car he was never notified that I was getting a ticket they just asked him for my insurance info and my drivers license. No officer ever went to the hospital to get my story so should I be waiting for a ticket in the mail?

Did the other driver not have a stop sign? What part of the right side of your car got hit (ie front-doors-1/4)?
You may get one yet. The fact that no tickets were issued will have no bearing on the liability determination made by your insurance carrier. You have turned in the claim right?

If you arn't willing to call the police you most likely have something to hide...if someone suggests that you not call the police that should tell you to get out the phone and call...PDQ!
I was in accident like that once, I immediately dialed 911. The officer cited the guy with 4 tickets and took him in hand cuffs to jail...he was a criminal and was a con artist too.

Momo--you make some valid points, however, they don't pertain to this particular thread. The police DID respond to this accident...the OP just didn't talk to the officer personally as she was transported from the scene via ambulance. :wink:
