Yes Pat, you can sue the insurance carrier but you should get all the aspect evaluated properly before taking such a decision.
Expecting you have faced a serious claim denial (though you haven't mentioned anything regarding that, therefore more information is required). Have you received a proper letter from the insurer regarding the reason of denial?
I would also suggest you to go through the policy document to ensure that their denial isn't correct.

we need some more information still. which carrier is related and we should go through the state policy to judge what's the excatly time allowed.
