Hello I am running a catering business, I need to get insurance so I can get the NY State Permit to operate a Food Service Establishment, Permit id # DOH-0061. My workers are getting paid $1 per plate sold and they keep all tips they receive when delivering the food. I deliver only. They call order a plate of food, and I deliver it, or one of my cousins deliver it.

Please someone tell me where I can get the proper coverage to obtain the permit I have to get right away. I started this business on march 1 , just decided to give it a try and its been very successful. I must get legal immediately !

thank you,

D

Such a compensation arrangement in California would violate state labor law if it did not add up to the minimum hourly wage. Tips are supposed to be reported by the employee and can be used as credit for up to 15% of the employee's hourly wage, or an employer can "deduct" up to 15% of the employee's hourly wage as imputed tip income.

My agencies are not licensed in NY. However, I would go onto Travelers site and find a local agent. This company should have a catering product that fits your needs. Another company to consider would be The Hartford. However, they have incurred some issues the past year and I'm hesitant to recommend.
