i'm in california my medial insurance paid for my aunto accident health costs, now my car insurance has offered me a seatlement of 5000 dollars do i have a right to keep the money?

Hi Malone, I'm sure the experts will shortly be around to solve your dilemma. However, as far I know, most of the states allow the health carrier to subrogate against the auto insurer if the insured has the PIP or Medpay.

IMO you shouldn't settle until you are sure that no future medication is required. Once you settle with the insurer and sign the release form, you would not be able to pursue the claim in the future. Most state laws would restrict that. California, however, doesn't allow the insured to double dip.

my car insurance already refuses to pay any more physical therapy treatmensts .i had 5 more left.my car insurance says that i didnt have enough car damage to be hurt.

Hi Connie, I can not see how your car insurance can assume you need no more coverage for physical therapy. Have you had your physical thereapist call or contact the insurance provider in anyway to show you needed to finish?
As for the medical bills. I am going through something simialiar. Who do you think you have to pay back? You own personal health carrier or your car insurance med pay? If it is your own personal health insurance then you probaly will have to pay them back. I myself have to but am hoping to settle for less than they paid. Some carriers will drop the amount by 25% or sometimes one third of what they paid out.
If it is your auto med pay that covered the bills then it is my understanding that they will not have to be paid back. There are experts around this site and hopefully one will drop in. I am just giving you information from my personal experience. Good Luck.

i took the easy way out and settled it. the stree os it was making me ill. i had always though aaa insurance was a the best. now i know different.

Settling with an insurance company can be stressful and time consuming. Glad to see you got it all taken care of. I just hope that your personal health insurance did not pay any of the bills because some times they will want money back. I am glad though you got everything taken care of. Good luck.

That is what we are in this business for. :) It is unfortunate that both the insurance and the medical worlds are so complex that people feel lost in the system. That is not our intention. Our goal is to take care of you when you need it most.
