Stolen Vehicle

If my vehicle is stolen and I file a theft report advising of such and notify my insurance company that my car was stolen --- am I liable if the suspect(s) cause damage to a third party while in possession of my stolen vehilce? Is there case law for California regarding no liability?

You would not be liable as the person did not have a reasonable belief that you allowed him/her to use the vehicle and you had no control over the operation of the vehicle.

No you will not be responsible for the damages caused to the other party because the vehicle was stolen from you.

The damages were caused by the 'non-permissive driver', which is not covered in your auto policy. The other driver is required to file the claim with his insurer under the uninsured motorist coverage.

Most likely the insurer will decline the claims against your policy. I agree with Jeremy, it'll be considered as the non-permissive use of the vehicle. I'm sure that California has no different law regarding this issue.

Inform your insurer and also get hold of the police report. It'll act as the supporting document for you.

Have you been contacted by the other driver regarding the damages caused to his vehicle?

* Look for legal counseling
* You'd need to know about the differences between auto theft rules & the federal laws
* Learn more about the differences between the thefts of different magnitudes

In a 'true' theft you will not be held liable for what the theif does with your vehicle. period.

i dont think you will be responsible. the same thing happeend to a friend and they just added the charges to the person who stoled and caused the damages.

Since the car was stolen, you obviously didn't give him permission.

My sister in law had her vehicle stolen and they took it four wheeling. There was quite a bit of damage done to the vehicle and the ins. company refused to pay....wanna know why???? They admitted to leaving the keys in the console...homeowners wouldn't cover it either.
