Accident with small damage

The idiot in nfront of decided that he would simply stop dead in the middle of I-95 in Florida. I had just enough time to take evasive action to my right forcing me to take out a few traffic cones. I pulled over to remove them from under my truck and he pulled up and said that I hit him. He hda a small amout of paint that had flaked off his bumper. No dent, no scratch , no structural damage whatsoever. I dont think I hit him. Anyway he calls the police and they come and were actually laughing and commenting on how he should be thanking me due to the fact that he stopped dead and that was all the damage he got. They had us swap info and told him to get a few estimates then call me to work it out. No ticket, no report nothing. He gets home and contacts my insurance company. Heres a guy with a 13 year old car with about 50 dollars worth of damage to it that I dont even know that I did, and hes making this a big deal !! its not like hes driving around with his bumper falling off !! Geico called and I told them the story and they said they will investigate. What am I looking at here?

An increase in your rates for starters... :roll: Unfortunately there is no fifty dollar repair since that rear cover is going to have to be repaired and refinished (minimally)...4-500 bucks I'd guess. Next thing is (grab your blood pressure meds)...I wouldn't be surprised to see him file an injury claim as well.

Unfortunately, I (and other adjusters I'm sure) see this daily..Your carrier should at the very least measure the damage to make sure you even ''could've'' hit him. The fact that he stopped dead in his tracks (why by the way did he stop)..will only go to point out that you were either going too fast for conditions or didn't have proper care and attention to traffic (sorry, I don't make the rules).

If you don't think you struck this car...you should insist that Gieco get the vehicles together to make sure there is even a possiblity. If you however, say, "I'm not sure"...not good for you, other guy IS sure.

Look at this from a 3rd person's point of view... no one (no one) is simply going to stop in the middle of an Interstate for no reason whatsoever. I've been driving for about 30 years and been handling claims for about 20. I've never seen this nor heard of it. There is always a reason (good or bad). Also, if the person told the police that he just stopped for no reason I'm _sure_ they would have issued a citation to him for causing an accident and creating a _very_ dangerous situation. Then there is a question as to why you did not have time to react to him stopping. Here is the thing with that... every needs to maintain a safe distance from the vehicle in front of them. There is a 2 second rule I'm sure you have heard of. Think about this next time you are on the highway and do the counting. See how far you are behind the vehicle in front of you? That is the _minimum_ distance you should be. Now look around at all the other cars and see how close they are. I'm betting you will see that most people drive too close. Now when you say you did not have time to stop, did this other person _slam_ on their brakes? If so, we have a person just out of the blue, for no reason, slamming on his brakes in the middle of the interstate. How do you think that version is going so fly with a person who was not there? Pair this up with the fact that you should still have plenty of time to stop behind this person and you have an at fault accident against you. Of course, the other person _is_ going to have a legit reason for stopping (they always do). You mention traffic cones.... I'm guessing this was a construction zone? Perhaps this is why the person slowed down quickly.

GEICO should investigate to see if they can match up the location of the damages but it's not looking very good for you given what happened.
