Emploer Cancelled Health Ins

Hi,
I have a family member who's employer cancelled his med ins. with no notice. He is in the middle of Throat cancer treatments. BC has notified him he is not eligible for cobra because he has not had BC for 18 months. ( employer made him change from univera to BC about 15 months ago) Does he have any choices or legal rights?

Thanks,
Donna

There is not enough information posted here to give an answer. Group insurance for an entire group of employees cannot be cancelled by an employer without notice to the employees of their right to continue coverage on an individual basis. Group insurance cannot be cancelled on just one employee while leaving coverage intact for all other employees.

COBRA coverage must be elected within 60 days of the "qualifying event". But COBRA does not apply if group insurance is being terminated for the entire group.

With more detailed information -- especially a timeline -- better answers can be given.
