I have BCBSofSC an have contacted DOI due to BC not processsing claims correctly an them incorrectly adjusting my deductibles paid. BCBS sent me a letter saying all was corrected but its not. Now DOI said I have to file a rebuttal. BC has started my deductable over 2 times in a benefit year, therfore claims are not being paid. They even offered to extent my policy period for one month as a favor. I am so stressed in dealing with them!!! Can tey be sued for bad faith

I think you posted this question previously in another forum. The short answer is, yes, you may sue anyone for anything. It doesn't mean you will win.

Your first course of action should be to file a complaint with your State's Department of Insurance. If that doesn't work, then you can seek an "insurance bad faith" attorney's advice.

I have filed with the dept of insurance, see above. BCBS sent their reply back to SCDOI saying all was corrected and it wasnt.

The Dept of Insurance told me if I wasnt satisfied w/ BCBS answer to my complaint I would have to file a rebuttal. I dont wont to mess with them any furhter. I need legal help now.

You will need to seek an insurance bad faith attorney. Check with your local bar association or legal aid society. Some county courts maintain such referral lists.
