If someone was in a car accident and it wasn't their fault. They got a lawyer. You settle. The health insurance sends a lien letter to your lawyer. Your lawyer in turn sends a check for the amount they request and states, 'Enclosed find a check in the amount of $xxx.xx as full payment.' The health insurance receives and cashes the check but refuses to send a release of lien letter, can the health insurance come back on you for more money down the road? According to IL law?? The lawyer won't release the remaining balance of the settlement monies to you because of not receiving a release of lien letter; is that legal??

Ah, Illinois . . . the land of fine upstanding citizens such as Al Capone, Richard J Daley, and Rod Blagojevich. And there are others in high political office left unnamed.
Has your attorney demanded a release? One should have been sent with the check or, preferably PRIOR to sending the check. When one has hired an attorney, and is paying that person for representation, one should be asking the attorney questions such as these.
Can the attorney withhold remaining funds? Probably not, but who are you going to get to sue the attorney?

Why don't you ask your attorney these very questions. He or she should be able to help you out better.

Well, perhaps you failed to read the OP's post. His attorney has money that doesn't belong to him, but won't release it. How much more "help" will he provide to his client?
