Could you please let me know how quickly insurance companies provide COBRA information after your insurance ends? I had an insurance until Jan 2013 and now the insurance provider is saying that it was actually cancelled through my husband's firm and asking the monies paid to the doctors. However, they haven't sent me the COBRA information until now.

How is it possible that your husband’s employer terminated his policy in January?

If his company cancelled the group insurance plan, then your Husband isn’t covered under COBRA and has no health insurance from there on. Basically, COBRA ensures continuity of insurance policies of whatever insurance coverage your husband and his colleagues have. So, if there is no group plan, then obviously there is no COBRA too.

Speaking about the delayed release of the COBRA information, then in that case, from the date on which the mail was sent to you, then from that day to the next 60 days, you have the discretion to either accept or decline.

So, you are well within that waiting period to continue with the health plan, but you’ll have to pay premium on it “retroactively”. There’s nothing as such called free lunch (or rather, free insurance).

Yes, the insurance provider has the right to demand a refund in this case. But, then they are required to apprise you about this within 45 days. Therefore, the lax in discharging their own duties on time has given you added time to decide whether or not you’d want to continue with the group plan.
